Who can invest in real estate in India?

Non-Resident Indians (NRIs)
According to India’s Foreign Exchange management Act 1999 (FEMA), An NRI is an Indian citizen or a person of Indian origin, presently staying outside of the country for purposes of employment, carrying on business or vocation in circumstances for an indefinite period. An individual who spends less than 182 days during the preceding financial year will also be considered as NRI.

Person of Indian Origin:
A person who is not a citizen of India, could be considered as the person of Indian origin, when he is not a citizen of Pakistan or Bangladesh and if the person has a valid India passport or either of his parents or any of his grandparents was a citizen of India by the virtue of the Constitution of India or Citizenship Act, 1955.

Overseas Corporate Bodies (OCBs)
Overseas Corporate Bodies are mainly owned by Indian citizens and people of (Indian Origin Resident Outside India) which include overseas companies, partnership firm, bodies and societies, owned directly or indirectly holding with at least 60% holding interest. This includes any overseas trust in which not less than 60% beneficial interest is held by NRIs, directly or indirectly but irrevocably. OCBs can invest up to 100% in six specific areas of real estate development.
